NEGOTIATIONS, CONTRACT DRAFTING AND CONTRACT VETTING

We assist clients with negotiations in various areas and offer professional legal advice relative to drafting and vetting of contracts and agreements, including those relative to employment, construction, property -tenancy contracts and conveyancing, condominium regulations, amongst others.

FAMILY LAW MATTERS

Our clients appreciate our resourcefulness and expertise in addressing their particular sensitive needs and handling each case with professionalism. We strive to conduct all conflict resolution in a supportive and professional manner. Although most cases are resolved through settlement negotiations and mediations, we also have extensive trial experience in complex marital and family law matters.

PUBLIC PROCUREMENT

We advise clients on matters of public procurement, before and after the submission of offers in relation to public tenders. We advise on the interpretation and submission of calls for the provision of supplies and services. procurement of property and concession. We also support our clients in contract management.

We also assist and represent clients in disputes and challenges under Public Procurement rules and regulations, before the Public Contracts Review Board and eventually before the Court of Appeal. We also represent clients in disputes at contract execution stage, before the competent courts or through alternative dispute resolution such as arbitration proceedings particularly arbitration proceedings before the Malta Arbitration Centre.

We also assist contracting authorities in the issuing of new Public Procurement Cycles of various types such as Call for Tenders, Call for Quotes, Negotiated Procedures and Concessions, amongst others.

DEBT COLLECTION

Our firm assists clients in debt recovery. This is done by formally requesting payment of outstanding dues, proceeding with judicial letters and precautionary warrants, and the institution of court proceedings. We also offer our legal services in the enforcement of executive titles.

EMPLOYMENT LAW AND INDUSTRIAL RELATIONS

Our employment law and industrial relations practice covers nearly all areas of the employer-employee relationship, including discrimination, wrongful dismissal, constructive dismissal, unfair conditions, human resource policies and practice.
We have considerable experience and expertise representing and counselling employers and employees, in matters such as:

  • Drafting and review of employment contracts
  • Negotiation in conciliation proceedings
  • Wrongful dismissal
  • Employment discrimination, including discrimination on the basis of age, sex, disability, race, religion, medical condition, etc.
  • Disciplinary hearings
  • Administrative trials and hearings, before the Industrial Tribunal, Civil Court and the Public Service Commission

PROPERTY LAW

The right to property carries with it various rights and obligations in favour of the owner and also to third parties. Our firm offers legal assistance in matters relative to:

  • Rent law, including Constitutional proceedings

BUILDING AND CONSTRUCTION LEGISLATION AND CONTRACTS

Our firm may offer assistance in the drafting of building and construction contracts. A member of the team is also certified in the Management and Administration of FIDIC Contracts. We can also offer legal services relative to building and construction legislation.

ADMINISTRATIVE LAW AND PUBLIC ADMINISTRATION

Our firm also assists clients on issues relative to the legality of administrative decisions, and defends our client’s position before the relevant court or tribunal, in cases of judicial review of administrative actions, in line with the remedies provided under Maltese law.

RESIDENCY AND CITIZENSHIP

Our firm may offer its legal services and assist with:

  • The application for the regularisation of third country nationals (TCNs) arriving in Malta
  • The application for the Single Work Permit
  • The application under Key-Employee Initiative
  • The application for dual citizenship
  • The application for regularisation of and naturalisation of citizens

TORT LAW

Every person shall be liable for the damages which occur through his fault. Our firm advises clients on matters pertaining to tort law. We offer our legal services and support clients in motor claims, property claims, personal injury and other claims for damages, which may eventually lead to litigation before the competent court or tribunal. We will proceed with defending our client’s position through correspondence and eventually before the adjudicating tribunal.

LEGISLATION DRAFTING

The firm also carries out services in relation to legislation, such as drafting of new legislation, carrying out amendments to current legislation, transposing directives and regulations into domestic law and any service related to this sector. Our firm also assists in the formulation of impact assessments, memorandums and all relative documentation.
